Why Casey is Down
January 26th, 2007 | Posted in NewsHey, wanted to give y’all a heads-up on why Casey (I Am Facing Foreclosure.com) is down.
After Casey posted the well-written NDA and airtight slavery contract from the 2 unnamed entertainment/education and mentoring moguls yesterday, they complained to his web host and the web host shut him down for a DMCA violation:
Your account on the gator25 has been suspended due to a DMCA complaint. Due to the nature of the complaint we have are required to take action.
From our Terms of Service:
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email abuse@hostgator.com with the information required. A list of required information may be found here. If the request is of a licensing issue, we may require further documentation.
To get his service restored, he has to fill out an appeal form and submit it to them, so yeah, we don’t expect to see him back up there any time soon.
What is interesting, though, is that they shut him down not because of the stuff he posted, but because they claimed that he had a link to a Rich Dad video (not the video itself, just a link). That’s not a DMCA violation, but you can’t blame them (Gator) for pulling a CYA maneuver. (It also didn’t hurt that their complaint threatened Gator with litigation as well… What would you do if you were receiving 10 dollars/month and someone threatened you over that paltry amount?)
He’s working hard this morning to get his site restored (minus those docs), so we’ll keep you posted.
