Why Casey is Down

Hey, wanted to give y’all a heads-up on why Casey (I Am Facing Foreclosure.com) is down.

After Casey posted the well-written NDA and airtight slavery contract from the 2 unnamed entertainment/education and mentoring moguls yesterday, they complained to his web host and the web host shut him down for a DMCA violation:

Your account on the gator25 has been suspended due to a DMCA complaint. Due to the nature of the complaint we have are required to take action.

From our Terms of Service:

Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email abuse@hostgator.com with the information required. A list of required information may be found here. If the request is of a licensing issue, we may require further documentation.

To get his service restored, he has to fill out an appeal form and submit it to them, so yeah, we don’t expect to see him back up there any time soon.

What is interesting, though, is that they shut him down not because of the stuff he posted, but because they claimed that he had a link to a Rich Dad video (not the video itself, just a link). That’s not a DMCA violation, but you can’t blame them (Gator) for pulling a CYA maneuver. (It also didn’t hurt that their complaint threatened Gator with litigation as well… What would you do if you were receiving 10 dollars/month and someone threatened you over that paltry amount?)

He’s working hard this morning to get his site restored (minus those docs), so we’ll keep you posted.

    Casey, you did nothing wrong. Don’t worry. If Duane’s competent, take his advice seriously and fight right back. That contract is a joke. Their DMCA complaint is a joke. I don’t care if you were dumb enough to sign that contract, you’re in the clear. Find another provider and move on.

    I’m not a lawyer, but an e-mail doesn’t really count as “formal notification” as far as I know. When I was in a similar situation hosting content, a lawyer actually sent me certified mail and made demands. Then I had to sign away my rights and promise never to violate their trademark again. I wanted to fight it, but my lawyer told me to just sign the agreement and move on.

    Help this guy out, Duane. He could use some competent guidance before he makes more mistakes.

    I did not see anything that Casey posted that could reasonably be regarded as Confidential. The contract did not specify that it was confidential and could not be disclosed and as such, as one of the parties to the contract, Casey had every right to post it.

    I got the impression from the complaint posted above that the reason the web host took down the site was because there were defamatory comments on it. Since Casey Moderates comments, he may be held responsible for allowing those comments through. If he has clear rules for what moderating he does (such as no profanity) he would be in the clear, but since he lets some third parties be named and does not allow others to be (such as his wife), a judge would probably accept that he has a case to answer for defamation of character.

    This does not mean that Casey would lose the case. Since he has posted the contracts as written, and they are blatantly contrary to his interests, it is likely that a Judge would hold that the “defamation” was fair comment. This is especially true since Casey (to his credit) does also allow derogatory comments about himself to be posted.

    I am not an attorney. Casey, you need one. Duanne, no good deed goes unpunished.

    As dumb as it was for you to post that NDA contract I think a lot of people are seeing the conniving side of PRLINKBIZ. They are vultures of the worst kind. You suffer from being naive and you got in way over your head but the folks over at PRLINKBIZ saw that you were gaining traction with publicity and frankly wanted to own any future revenue streams from you. I got a chance to read the contract and it was absurd; they probably referenced a two hundred year old document from a cotton farm in the South for the wording. They come off as Apprentice wannabe-junkies and saw the potential to piggyback on your notoriety.

    If anything I hope their brand and image is exposed for what they really are; blood sucking vampires waiting to take a bite out of your neck. Like Simon said on American Idol, the way you make it in the business is by kicking someone when they’re down.

    Casey: I’ve been writing/signing contracts for 20 years. I’m not a lawyer, but I am an MBA and I’ve studied contract law. What you signed was obviously not written by a lawyer, or a professional business person. It is almost unreadable, and if brought before a judge, he’d spend more time laughing than ruling.

    For what it’s worth, I advise you to ignore these two witches of east phoenix. They have nothing enforceable on you. If they keep harrassing you and casuing your site to be shut down, you may to take action against them.

    Good luck and don’t worry anymore about that pathetic looking “contract”, it does not appear to be worth the toilet paper it was written on.

    Get an attorney to work for you pro bono. The contract is vague, yet you still signed it. This is your story and you have the every right to benefit from it moneywise. Stick with Duane, if it wasn’t for him you would not have realized the full impact on that contract (although one should ask why you diddn’t at least faxed it to your wife to see it). I know you’ll come out of this one, pray that the good Lord will give you inner peace to cope with all these problems. In the end you’ll feel a lot stronger and wiser.

    I am having Casey review EVERYTHING. He is quietly behind the scenes trying to work out payment plans with creditors, trying to get his unsecured debt %’s lowered, and contacting the lenders to work out a deal.. every agreement and contract is hopefully being addressed… INCLUDING the prlink one.

    Did ANYONE see that in the contract?? I wonder if Erin told RK.. we tried to do the right thing… I wonder what would happen to Erin if she is exposed for the fraud she is..???

    Them taking down Casey’s blog says all you need to know about them…

    In reading their complaint letter.. they are getting ready to sue everybody!!

    If they use the same genius to represent them as they did to write “THE CONTRACT”, then I will have to resort in having my 7 year old son defend Casey… then the playing field will be even..

It may well be that there is a defect in the contract to make it unenforcible, but just saying it doesn’t make it so.     Duane , your claim to be a professional suffers each time you post. Youa re childlike in your correspondence not at all like the successful businessman you purport to be. Are you a Lawyer? The issues that you fixate would have no bearing on the disposition of the so called contract. Why do you get hysterical over this issue?

    You’re a joke. You advised Casey to beg for this outcome. I would have expected an injuction but their action seems to have the same practical effect. Just because the NLL are jerks, mean, vague, didn’t perform your fantasy provisions does not an invalid contract make.

    I hope that the advice you give to your distressed home owners or credit challenged buyers (i.e. marks)is of a better quality than your
    legal advice to Casey. Some how I doubt it.

    Youre right I am not attorney. My attorney is an attorney. He is also AFLAC’s intellectual property attorney. He saw the contract back in Oct/Nov timeframe. He giggled then, he laughs out loud now.

    Finally, I just checked with Mensa.. they said everything is fine with my membership.

    Summary would be that there were three items listed as justification for takedown.
    Item 1: was a contract law/NDA item, not copyright. This item is not causal for a DMCA takedown.
    Item 2: was a ‘complaint’, covered by free speech.. can’t use DMCA here.
    Item 3: was a link to potentially copyrighted material, which the claimants probably did not own, and had not established ownership for. In addition, linking is allowed under DMCA (wholesale copying is not).

    This also means that hostgator.com may have lost their protection for their behavior under the DMCA copyright act.. (big pocket here).

    …. back to watching a train wreck…

    I don’t think the ‘permission denied’ on their websites was due to hacking. If you hold the high ground, you don’t need to hack their system. I suspect they did an amateurish shutdown of the page because of the bad press this was generating. Their business depends upon having good press and their face is plastered about their website. In addition, it would be interesting to find out if Kiyosaki weighs in because they were making claims about his video. I don’t think he would want to be associated with what these two did.

    For what it’s worth, I think the contract is legally worthless, but unless you’re planning on paying for Casey’s legal representation, it was dumb to post it on IAFF. Any resolution on the contract one way or the other will involve lawyers, which are a luxury Casey can’t afford. Any legal services Casey pays for would be much better spent keeping him out of jail for example.

    Besides, if the contract is unenforcable, wouldn’t it have been better to just ignore it? LeechBiz and Co. already said they planned to sit on it in case Casey was ever worth anything. Were he to ever become successful (haha) wouldn’t it be better to litigate this then? Why force the issue now when he can’t afford it and it should honestly be on the bottom of his priority list.

    Of course, it’s also kind of stupid for PrLB to kill Casey’s site, since he’ll never be worth anything if she ensures that his story dies. And now her site is dead too. I’m sure Kim K (and RK) probably doesn’t like the negative publicity either, considering she has absolutely nothing to gain from this. Anyway, unless Casey somehow monetizes his story (I’ve read rumors about Fox interest?), I have to say that this was a piss-poor call here.

    Casey spent today working on getting his blog back up rather than getting out of debt. Don’t get me wrong, today was a fun ride, but Casey doesn’t need any encouragement when it comes to making impulsive decisions.

    By the way, your seven year old son is an infinitely better choice for Casey’s defense rather than allowing him to defend himself. That is one call that I will back you on 100%.

    Query for the legal types: If Casey wished to file a legal action for tortious inteference with business relations (i.e., two dimwits causing his website to be shut down and causing him to lose whatever advertising revenue he had coming in), would he have to file in CA, where he is, or AZ where they are?

    Makes you wonder who has more to lose in this fight, Casey who has nothing, or the other side, who presumably have something. Besides, if Casey, loses, then can’t the story just change from “Iamfacingforeclosure.com” to “MyHusbandIsFacingForeclosure.com”

    NLL could have prevented this falling on them by taking the high road. They didn’t. Then they made false claims to an ISP with the purpose of preventing others from seeing that they are much like Casey. (2nd bad move on their part because it invites a lawsuit.     and read the definition of tortious interference in a business. One instance will not make much of a case, but if NLL does not quickly take the high road, they may be in for some trouble.
    In addition, I wanted to verify one portion before stating the following:
    Any contract to indentured servitude is illegal in the United States. If you look at the terms of the ‘agreement’, you see that they offer ‘mentoring’ with unspecific terms, but he gives them literally everything (and they get to specify whether they pay him or not). That is a pretty good fit for indentured servitude… which by itself can invalidate the agreement/contract.

    As for what will happen to Casey, I think it will take care of itself. With the new bankruptcy laws, it is very unlikely that the debt will get erased through any bankruptcy. In addition, the fraudulent mis-statement of income continually hangs over his head. Consider the debt load and the growth in the debt with respect to interest payments as I put at:

    .. now factor the amount of income to cover this and you are looking at required income of over 200,000 a year just to keep even with the interest on the debt.

Glad to see Casey is at least listening to someone and I pray that you and your business turn out to be legit.     I have had no conversations with Joy recently. I had one in the past trying to get her to let Casey out of the contract.. she hung up on me in 5 seconds..

    That Casey and I have a “secret deal” with FOX for a reality show. (I bought a few extra cases of popcorn in case this turns out to be true.) I wonder what I will say and do? stay tuned to this one..

    That I am actually PRLINK whatever…

    That I am secretly trying to get Casey out of that contract so I can buy his (insert anything here and its been said) ________ rights…

    That the IAFF website was down and somehow I was the cause to redirect traffic to this website so I can make millions. (by the way.. where did all my sponsors go… maybe people will send me money quietly)…

    That I had my attorneys go after the NLL for messing with Casey and that we brought down there website…

    That I am guilty be association with Casey and the fact that we have sponsored his website must mean that I endorse all of his previous activities…

    That I endorse the same people that Casey spent 30K on seminars and I am part of the Get Rich Quick crowd…

    That somehow I am RK’s secret mouthpiece…

    That I post too much on the day of the introduction as sponsors on IAFF so I must be trying to take over his website….

    That I don’t post enough and answer every question posed to me….

    That the fact that I want this kid to own up to his responsibilities, make amends, and everything else doesn’t just “add up”…

    That I am somehow giving Casey a secret kickback from ALL the money I am making from the website…

    That if I don’t stop sponsoring his website then all the people on his website will stop doing business with me (as if they were ;)…

    That I am a self righteous chest thumper…

    That I am a troll (found out what it means)

    That I should be paying Casey’s mortgages.

    b. “However, she was still offended by how she spent money and time on me, have me meet Robert Kiyosaki, and I sign the agreement only to back out 10 minutes later.”
    4. You are on record on multiple occasions stating that Erin and Joy acted in good faith and in your best interests, without any pressure or duress:
    a. ” She seems very genuine and I feel I can trust her. So over the next couple of days, as she starts arranging the phoenix trip, I tell her about my story.”
    b. ” I tell them that I now have a good feeling about them now that we have met in-person. Both of them really do seem genuine - just wanting to help me out.”
    c. ” On the way over, I talk to her some more about real estate and other things. I get a better feel for her as a person. I gain a certain level of respect for her real estate expertise and her “do the right thing” integrity-filled ISTJ guardian personality (my guess).”
    d. ”Both Prlinkbiz and The Phoenix Investor Lady seem so genuine. They just want to help me!”
    5. Regarding the consideration that you were to receive, you already knew that :
    a. ” The Phoenix Investor Lady is also willing to help me out of my foreclosure situation and teach me to be a successful real estate investor.”
    b. ” The other part of the offer was that, Prlinkbiz has a great idea for documenting and sharing my come-back story with the world. (Sorry I am not allowed to share the particulars.)”

    6. You admit that you agreed to the deal :
    a. ” So I impulsively tell Prlinkbiz I like the idea and say something along the lines of “letsdoit”. “
    b. ” I call Prlinbiz and tell her that I put the other guys on hold and I want to proceed.”
    c. ”I was offered a [great opportunity] and they have a very good real estate mentorship package as part of the deal. There was some miscommunication originally about that but today we got all that straightened out. I am also extending my stay here until the weekend.”
    d. “Prlinkbiz and The Investor Lady take me out to lunch again. I tell them about my decision to move forward. “Starting right now I will do whatever you want me to do and I will sign whatever I need to sign. Letsgoforit!!”, I say.”
    e. “I go on to tell them how sick I am of being in this mess and how I’m ready for action. I thank Prlinkbiz for arranging for me to meet Robert Kiyosaki. I thank her for introducing me to The Phoenix Investor Lady. I tell The Investor Lady that if she is still willing take me on, I’m ready… right now!”

    7. You admit that they sent you over the paperwork and gave you the ample opportunity to mull over and negotiate the deal:
    a. ” Prlinkbiz sends me over some paperwork and invites me to a 3-way instant messenger chat with The Phoenix Investor Lady to iron out the details.”
    b. ” At this point, [The Phoenix Investor Lady] and I agree with you. It would be better to meet face to face. What you need to do is go through and decide what you want and what you need, and perhaps add that into the contract or specify which parts you would like changed. It would be great to hammer it out and then have it ready to be signed and done Monday night when you get here. ”
    c. ” We then address my concerns about working together. We talk through the issues and get better understanding of both sides. Very productive meeting.”
    d. ” We just want to see you start working on a solution one way or another… with us or someone else“, they said. I appreciated their genuine understanding and encouragement!”

    8. You have already absolved Prlinkbiz from any wrongdoing or that you signed under duress:
    a. ” I don’t want to blame Prlinkbiz too much. I found out later that at this point of the story she thinks that I’m getting cold feet.”
    b. ” I later found out Prlinkbiz was very concerned about me too. To her it looked like I said “Yes” but then tried to go back on my word. So that’s why she was applying pressure.)”
    c. ”Again, I don’t blame the ladies too much. I probably wasn’t doing a good job of communicating my concerns to them. I was looking for a step-by-step plan and they didn’t appear to have one. We obviously had a difference of expectations.”

They were both very encouraging and supportive of me. We just were never truly on the same page.     9. However, you admit when directly asked about your wife’s knowledge of the deal, you lied to take advantage of the offer Erin and Joy provided you ”While I’m signing, the question comes up. “Is your wife aware of all this?”. I fire back: “Of course! She is supportive of my decisions, as long as I find a way to get us out of this mess and allow her to continue her education.”

    10. You clearly admit that you signed a legally binding contract without duress.”She’s right. It’s my fault for screwing around. It wasn’t like I was under the influence of drugs or anything (Would you consider “impulsivity” a drug?). I signed that agreement and I need to learn to take responsibility for my actions.” and then you tried to barter your way out of it.

    I am sorry that you feel that way about me. The majority of commenters on his blog all recommended that Casey should get a full time job, and I thought that many people would be happy that Casey has finally followed their advice and done that. While he has not been skilled in his real estate deals, he is skilled with technology and database organization, and the services that I need. I have had a need for someone to assist me in my database organization and tech issues, and Casey has some decent skills in this area. In fact, he could probably get a high paying programming job if he wanted. I saw this as a win win situation by providing Casey with a base income, while at the same time getting a useful assistant for a very small monthly investment.

    I don’t know why someone would feel the need to write negatively about me online. I haven’t done anything that should deserve that. I grew up with my mom working for charities, and I have always had a passion to help people whenever I can. So this is my small way of paying it forward. But I am a businessman at the same time, so if Casey does not perform, then I will not continue to pay him. We have recently revised our work agreement and I am happy with his performance so far.

    I believe strongly in working with integrity and good ethics. I do not agree with the way that Casey purchased his properties, or in his actions since then, but I do believe in giving people a second chance. If he needs to do time because of this and pay significant restitution, then so be it. Until then, I will continue to give him a shot at working with me. I hope that this helps clear some things up for you. It is your choice if you want to continue to feel the way you do about me, but perhaps you will choose to give me the benefit of the doubt as a decent person until I prove myself otherwise.

    What exactly does posing the contract on the web accomplish? The NLL still have the contract. Casey signed it of his own free will. If he ever makes any money they will still sue him. As entertaining as this weekend was, I do not see how it changes Casey situatuon.
